On the 15th of July 2016 a new law came into force regarding the legalization of houses built in the country. The majority of the houses built in the country in Axarquía area, are built on land called SUELO NO URBANIZABLE O RÚSTICO, in locations where it was not permitted to be built.
The new law facilitates the legalization of finished houses located on “parcelaciones urbanisticas”, which means more than one building on the same plot. The new legislation constitutes neither an amnesty nor a full legalization of the properties affected, but this stops the building being demolished.
If you have a house built on rustic land and other houses have been built on the same plot, whether there are boundaries or not, you are able to legalize the property under the new regulations.
The requirements are:
- The house including pools, garages, etc, must be over 6 years old.
- The house must not be in protected areas, nor in an area liable to flooding.
- The house must not have any pending legal procedures in the Town Hall or the Junta de Andalucia.
This new law does permit property owners to access basic services such as electricity and water, register the property with the land registry office and enjoy the benefits of judicial security.
At the end of the day, your house will be legalized and you have no need to worry further. In future all legalized properties will be easier to sell.
